1. Acceptance of Terms

By downloading, installing, accessing, or using Pepty (the “App”), operated by qlabs LLC, a Texas limited liability company (“qlabs,” “we,” “our,” or “us”), you (“you” or “User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and qlabs LLC. We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of the revised Terms.

You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Description of Service

Pepty is a mobile application that provides peptide research tracking, administration logging, scheduling, and price comparison features. The App may include, but is not limited to:

• Peptide protocol creation and management
• Administration tracking, reminders, and scheduling
• Progress tracking and journaling
• Price comparison across third-party peptide vendors
• Links to third-party vendor websites for purchasing peptides
• Educational and informational content related to peptides

The specific features and functionality of the App may change over time at our sole discretion.

3. Medical and Health Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

Pepty is NOT a medical device, and it does NOT provide medical advice, diagnosis, treatment, or prescriptions. The App is intended solely for informational and personal tracking purposes.

3.1 No Medical Advice

• Nothing in the App should be construed as professional medical, pharmaceutical, or healthcare advice.
• The App does not recommend, endorse, or suggest any particular peptide, dosage, protocol, or treatment regimen.
• Information provided in the App is for general informational purposes only and should not be relied upon as a substitute for professional medical advice.
• Always consult with a qualified healthcare professional before starting, modifying, or discontinuing any peptide protocol.

3.2 No Endorsement of Peptide Use

The existence of tracking features, price comparisons, or informational content within the App does not constitute an endorsement, recommendation, or promotion of any peptide product, substance, or therapy. qlabs LLC does not encourage or discourage the use of any peptide or related substance.

3.3 Assumption of Risk

You acknowledge and agree that:

• The use of peptides and related substances carries inherent risks, including potential adverse health effects, allergic reactions, drug interactions, and other complications.
• You are solely responsible for your health decisions and any consequences arising from peptide use.
• You will not hold qlabs LLC liable for any health outcomes, adverse effects, injuries, or damages resulting from your use of peptides or your reliance on any information provided by the App.
• In case of a medical emergency, you will contact emergency services immediately rather than relying on the App.

3.4 Regulatory Status

Pepty does not make any claims that any peptide products listed, referenced, or compared in the App are approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body for any particular use, unless explicitly stated otherwise. Many peptides are sold as research chemicals and are not approved for human consumption. You are solely responsible for understanding and complying with all applicable laws and regulations regarding the purchase, possession, and use of peptides in your jurisdiction.

4. Price Comparison and Affiliate Disclosure

4.1 Price Comparison Disclaimer

The App provides price comparison information from third-party vendors as a convenience. You acknowledge and agree that:

• Prices displayed may not reflect the most current pricing and may change at any time without notice.
• qlabs LLC does not guarantee the accuracy, completeness, or timeliness of any pricing information.
• We do not control, endorse, or assume responsibility for the products, services, pricing, availability, quality, purity, or safety of any third-party vendor or their products.
• Actual prices at the point of purchase may differ from those displayed in the App.

4.2 Affiliate Relationships and FTC Disclosure

AFFILIATE DISCLOSURE:

Pepty contains affiliate links. When you click on links to third-party vendor websites and make a purchase, qlabs LLC may earn a commission at no additional cost to you. In compliance with FTC guidelines:

• qlabs LLC has a material financial connection with some or all of the third-party vendors.
• Affiliate commissions may be earned when you click on vendor links and complete a purchase, at no additional cost to you.
• Affiliate relationships may influence the selection, ranking, or prominence of vendors and products displayed in the App.

4.3 Third-Party Vendors

When you click on a link to a third-party vendor, you leave the App and enter a website operated by a third party. Your interactions with third-party vendors are governed solely by that vendor's own terms of service and privacy policy. qlabs LLC is not a party to any transaction between you and a third-party vendor and is not liable for any disputes, damages, losses, or claims arising from your transactions with third-party vendors.

5. User Responsibilities

As a user of Pepty, you agree to:

• Use the App only for lawful purposes and in compliance with all applicable laws and regulations.
• Comply with all applicable laws regarding the purchase, possession, and use of peptides in your jurisdiction.
• Consult with qualified healthcare professionals before making any health-related decisions.
• Not rely on the App as your sole source of information for any health, medical, or purchasing decisions.
• Maintain the security of your device and any data stored within the App.
• Provide accurate information when using the App.
• Not use the App in any manner that could interfere with, disable, overburden, or impair the App.

6. Prohibited Uses

You may not use Pepty to:

• Track, promote, or facilitate the use of illegal substances or engage in any illegal activity.
• Distribute, resell, or commercially exploit the App or its content without written permission.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Circumvent, disable, or interfere with any security features.
• Scrape, harvest, or collect data from the App for commercial purposes without written consent.
• Impersonate any person or entity or misrepresent your affiliation.
• Use the App to provide medical advice, prescriptions, or healthcare services to others.
• Transmit any malicious code, viruses, or other harmful software through the App.
• Use automated means (bots, scrapers, crawlers) to access the App or extract data.

7. Intellectual Property

The App, including all content, features, functionality, design, graphics, logos, trademarks, and code, is the exclusive property of qlabs LLC and is protected by United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. This license does not include the right to:

• Copy, modify, or create derivative works based on the App.
• Use any data mining, robots, or similar data gathering methods.
• Sublicense, lease, rent, or transfer your rights to any third party.
• Use qlabs LLC's trademarks, logos, or brand elements without express written permission.

8. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that certain features of the App may require data collection as described in our Privacy Policy.

9. App Store Terms

If you downloaded the App from Apple's App Store, you acknowledge and agree that:

• These Terms are between you and qlabs LLC, not with Apple Inc.
• Apple has no obligation to provide maintenance or support services for the App.
• Apple is not responsible for addressing any claims relating to the App or your use of the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QLABS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS; WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR TIMELINESS OF ANY CONTENT; AND WARRANTIES REGARDING THE QUALITY, SAFETY, OR EFFICACY OF ANY THIRD-PARTY PRODUCTS REFERENCED IN THE APP.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QLABS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION ANY HEALTH COMPLICATIONS, ADVERSE REACTIONS, INJURIES, OR DEATH; ANY FINANCIAL LOSSES ARISING FROM PURCHASING DECISIONS; LOSS OF DATA, PROFITS, REVENUE, BUSINESS, OR ANTICIPATED SAVINGS; ANY DAMAGES ARISING FROM INTERACTIONS WITH THIRD-PARTY VENDORS; OR BUSINESS INTERRUPTION.

IN NO EVENT SHALL QLABS LLC'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO QLABS LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless qlabs LLC from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising out of or relating to:

• Your use of or access to the App.
• Your violation of these Terms.
• Your violation of any applicable law, regulation, or third-party right.
• Any health decisions or outcomes resulting from your use of the App.
• Any transactions or disputes between you and third-party vendors accessed through the App.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

13.2 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@qlabs.studio to attempt to resolve the dispute informally within thirty (30) days.

13.3 Binding Arbitration

If the dispute cannot be resolved informally, you and qlabs LLC agree that any dispute shall be resolved by binding individual arbitration administered in accordance with the rules of the American Arbitration Association, conducted in the State of Texas.

13.4 Class Action Waiver

YOU AND QLABS LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your license to use the App is immediately revoked.
• You must cease all use of the App and delete it from your device(s).
• Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3, 4, 7, 10, 11, 12, and 13.

You may terminate your use of the App at any time by deleting it from your device(s).

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and qlabs LLC concerning the App.
• Severability: If any provision is found to be invalid, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver.
• Assignment: You may not assign your rights without our prior written consent.
• Force Majeure: qlabs LLC shall not be liable for any failure or delay due to circumstances beyond its reasonable control.
• Notices: Notices to qlabs LLC should be sent to support@qlabs.studio.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last Updated” date and providing additional notice through the App or our website. Your continued use of the App after any changes constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must discontinue use of the App.
